Red

Red indicates a need for improvement in consequences for offenders.

Yellow

Yellow indicates strength in some areas, but a need for better deterrence or punishment.

Green

Green indicates both capital punishment as well as a strong minimum sentence of at least 25 years for offenders. 

We created this map to be a helpful activism tool to educate and inspire laws that increase penalties for the heinous crime of child rape.

Our leadership initiatives have resulted in more states introducing the harshest penalties for these crimes. More states like Tennessee, have started introducing the death penalty and we want to equip concerned citizens with the tools they need to advise these important efforts. Survivors deserve justice.

Freedom Forever’s rating system is evaluated by a team of legal and field experts to make the most accurate determinations based on available data. The rating system is developed based on existing state laws and applicable state enforcement. Federal statutes and enforcement are not evaluated in this rating system but may affect existing state laws. Please note that while we do our best to ensure the rankings are current, the laws used to rank each state may have changed since our latest update. State legislatures, courts, and federal law can all affect state laws, thus causing almost constant fluctuation. 
 
Our organization performed an analysis of statutes and punishments for each state for the sexual assault (rape) of a child.  We looked at the strength of protections of children primarily under the age of 12 and punishments for convicted offenders.  
 
A Red state would indicate a need for improvement in both the minimum required sentence of an offender as well as improvement in punishments such as the death penalty. 
 
Yellow would indicate strength usually in one area such as a minimum 25 year prison sentence, but needs improvement in other areas of punishment for deterrence. 
 
A green state would represent a state that has both capital punishment as well as a strong minimum sentence of at least 25 years for offenders.  Other factors considered may be that a state doesn’t protect all prepubescent children and the age should be increased.

Freedom Forever is aware of transparent data deficiencies in the enforcement aspect of child protection laws. While states having protective laws is the foundation of making protection of children a priority, the laws have no impact if states do not enforce them. Unfortunately, enforcement data (including charging, jail time, and bail and bond practices) is not readily released to the public, so we were not able to include it in our rankings. Freedom Forever believes it should be, so that individuals can better advocate for better enforcement practices. This site is not a supplement for legal advice.
